Terms of Use — TraderMindset360 (TM360)

By accessing or using the TM360 website, products, services, courses, community, content, or any related features (collectively, the “Services”), you agree to these Terms of Use (“Terms”). If you do not agree, do not use the Services.
2) Who We Are
TM360 (“we,” “us,” “our”) provides educational content and services related to trading performance, mindset, self-talk, emotional regulation, and identity transformation.
3) Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. By using the Services, you represent that you meet this requirement.
4) Educational Purpose Only — Not Financial Advice
TM360 provides education and coaching. Nothing on the Services is investment advice, financial advice, trading advice, or a recommendation to buy or sell any security, cryptocurrency, or other financial instrument.
You are solely responsible for your trading and financial decisions, and you agree that TM360 is not liable for your outcomes, losses, or decisions.
5) No Medical or Mental Health Treatment
The Services may discuss stress, emotions, habits, trauma, and mindset. TM360 does not provide medical advice, psychotherapy, diagnosis, or treatment. If you need medical or mental health care, seek a qualified professional.
6) Accounts, Access, and Security
If you create an account, you agree to provide accurate information and keep your login credentials confidential. You are responsible for all activity under your account. We may suspend or terminate access if we reasonably believe your account is compromised or used improperly.
7) Purchases, Billing, and Subscriptions
If you purchase a course, membership, or other product:
● You authorize us (and our payment processors) to charge your selected payment method.
● Prices and offerings may change at any time (changes do not affect prior purchases except for renewals where permitted by law).
● For subscriptions, you authorize recurring billing until you cancel.
Chargebacks: Initiating a chargeback without first contacting support to attempt resolution may result in loss of access to Services and content, to the extent permitted by law.
8) Refunds
Refund policies (if offered) will be posted on the checkout page, order form, or sales page for the specific offer. If no refund policy is stated, purchases are final to the extent permitted by law.
9) License to Use Content
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use.
You may not:
● Copy, reproduce, distribute, sell, sublicense, or exploit any content without written permission
● Share logins or grant access to others
● Record, scrape, download in bulk, or republish course/community materials
● Remove copyright, trademark, or proprietary notices
10) Community Standards (If Applicable)
If the Services include a community, comments, or user-generated content:
● Be respectful and do not harass, threaten, or shame others.
● Do not post illegal content, hate content, sexually explicit content, or content that violates others’ rights.
● Do not share anyone’s private information.
● Do not spam, solicit, or promote unrelated offers without permission.
We may remove content or restrict accounts at our discretion to protect the community and Services.
11) User Content and Feedback
If you submit content (comments, testimonials, messages, feedback, etc.), you grant TM360 a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display it for operating, improving, and marketing the Services, unless you explicitly request otherwise in writing.
Testimonials/Results: Any testimonials or examples are not guarantees of outcomes. Results vary based on many factors.
12) Intellectual Property
TM360 and all related content, branding, trademarks, logos, graphics, videos, audios, worksheets, scripts, and course materials are owned by TM360 or licensed to TM360 and protected by intellectual property laws. All rights not expressly granted are reserved.
13) Prohibited Uses
You agree not to:
● Use the Services for unlawful purposes
● Attempt unauthorized access, hacking, or interference
● Use automated tools to access, scrape, or disrupt the Services
● Impersonate any person or misrepresent your affiliation
● Upload malware or harmful code
14) Third-Party Links and Tools
The Services may link to third-party sites or integrate third-party tools (e.g., payment processors, analytics, community platforms). We are not responsible for third-party content, policies, or practices.
15) Disclaimer of Warranties
The Services are provided “AS IS” and “AS AVAILABLE.” To the maximum extent permitted by law, TM360 disclaims all warranties—express or implied—including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation or any particular results.
16) Limitation of Liability
To the maximum extent permitted by law, TM360 will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or trading losses, arising out of or related to your use of the Services.
In any event, TM360’s total liability for any claim will not exceed the amount you paid to TM360 in the twelve (12) months before the event giving rise to the claim.
17) Indemnification
You agree to indemnify and hold harmless TM360 from any claims, liabilities, damages, losses, and expenses (including attorneys’ fees) arising from your use of the Services, your violation of these Terms, or your infringement of any rights.
18) Termination
We may suspend or terminate your access at any time if you violate these Terms or if we discontinue the Services. Upon termination, the license to use the Services ends.
19) Changes to These Terms
We may update these Terms from time to time. The “Last Updated” date will change. Continued use after updates means you accept the revised Terms.
20) Governing Law
